Am I due compensation from BA?

    I wonder if you could help establish if I’m due compensation from British Airways, my insurance or just have to accept and get on with it.

    We are due to fly in F from JFK to LBA via LHR tomorrow evening (23rd July) at around 11pm and the flight has been cancelled. The earlier flight offered is not suitable since we don’t arrive at JFK until 7PM from Orlando. We received this news 60 hours before the flight.

    We are now having to fly the following day at 1830 and fly to MAN via LHR.

    Costs incurred are:
    Taxi to and from JFK
    Hotel
    Taxi from Manchester to Leeds

    BA said we are not entitled to anything as we were told before arriving at the airport.

    All help and advice appreciated.

    I believe BA are responsible for getting you to your destination (LBA) and should be offering to cover reasonable out of pocket expenses, as you detail above. This applies to all passengers, in whichever cabin they are travelling. You’d rather hope they would be taking good care of two First Class travellers!

    That said, there are seats available on this connection:

    1. BA 114 23JUL JFKLHR 2150 #0955
    2. BA 1342 24JUL LHRLBA 1240 1340

    This allows almost 3-hours connecting time from the arrival of your flight from Orlando so, if suitable, get BA to rebook you and hopefully problem solved.

    It seems that BA are wrong.

    As UK is still a member state of EU, they are obliged to pay both the cost you have incured (taxi + hotel) and a financial compensation of € 600.

    I wanted this flight however should we get delayed on our JetBlue flight into JFK they were not prepared to assist so would have to fund a new flight.

    I’m guessing the fact we are using points for the flight might make them less willing!

    I should also point out that my LHR to LBA is booked on a separate reference if that makes a difference? My friends travelling with us in WTP are booked through to LBS on one reference but are now having to travel via MAN

    Ah, separate tickets means they are really only responsible for getting you back to LHR but, as far as I know, your rights as a ‘points’ passenger should be the same as if you had paid a cash fare.

    From the sound of it, you are BA Gold or Silver so have you tried the Exec Club for assistance?

    I’m bronze hence I anticipate a long painful wait followed by a frustrating and tedious conversation on the phone!

    Wow! How on earth did you manage to get enough points for a 1st Class ticket if you’re only Bronze?

    I did it using Amex Credit Card. My wife is very good at collecting points using it!

    As you are booked in F, then you could reasonably indulge in NY by staying in a similar quality “first class” (e.g. the Waldorf?) Manhattan hotel – could mean an enjoyable day paid for by BA with 600 euros pocket money ?

    My understanding is that as you have been advised of the cancellation less than a week before departure the airline must arrange alternative travel that gets you from A to B departing not more than an hour before and arriving not more than 2 hours later.

    If they fail to do this then you will collect compensation of €600 per person for a delay of over 4 hours and €300 if less than that.

    Unfortunately in this case A to B is JFK to LHR. The fact that LBA is on a different ticket means you assume the risk on that. You may find BA sympathetic, or you may not, but I don’t see any requirement do them to transport you from MAN to LBA.

    City AM did a page article about EU Compensation this morning, useful read. Only 2% of people who are eligible actually claim.

    Thanks for everyones help on this.. BA have confirmed I will receive the 600 euro, Is anyone able to advise if they should still be paying for the hotel, food and taxis?
